Image on Tshirt based on altered image from an original photo or screengrab infringeing copyright?
I want to create a series of T shirts for a small fan site. The images are created from photos of the pop star or on screen grabs from videos. There are already drawings/paintings for sale on that site (not made by me) obviously based upon existing amd well known photographs. Will the images on my T shirts infringe copyright as they are so altered and not a straight copy/paste from existing images ?
Altering an image does not remove the protection of the copyright. The owner still owns it.
Careful, there are lawyers making a business of surfing and looking for purloined images on the internet. And they have the teeth and the right. They rarely lose.
"Developer scanned Photographer's copyrighted photograph, altered the image by using digital editing software, and included the altered version of the photograph in a multimedia work that Developer sold to consumers. If Developer used Photographer's photograph without permission, Developer infringed Photographer's copyright by violating the reproduction right (scanning the photograph), the modification right (altering the photograph), and the distribution right (selling the altered photograph as part of the multimedia work).
A copyright owner can recover actual or, in some cases, statutory damages from an infringer. The federal district courts have the power to issue injunctions (orders) to prevent or restrain copyright infringement and to order the impoundment and destruction of infringing copies. "
