Does anyone know if TX has a law governing how fast police cars can go on residential streets?
My 4yr old daughter and I were outside. I was walking along next to her, when I heard a car accelerating fast. I had just enough time to shout at my daughter and grab her shoulder to pull her back, before a police car came speeding by. No lights, no sirens, and come to find out, irony's of irony, he was going to assist another officer with someone who had been speeding. If I would've been another foot from my daughter, where I could not reach her, he would have hit and killed her. He never even noticed her, continued accelerating to the point that he ran through the yield sign further down, and bottomed out his vehicle on a dip. I promptly called his supervisor, who told me 1) that there was no law governing how fast an officer can go in an emergency situation, and 2) wanted to know if I knew that a person is not required to stop at a yield sign!
I was just wondering if it was true that they can go as fast as they themselves deem necessary, and if so, how can I change it?
Generally, there are no laws setting a specific speed a police car is allowed to go. However, the officer is required to use "due diligence and care" in responding to emergencies. Even with emergency lights and sirens, the officer does not have unlimited rights to the road. If he had struck your daughter he would have been charged with a number of criminal offenses. If a traffic accident had occurred when he blew through the Yield Sign, he would have been accountable for the accident. And, of course, his department would be civilly liable for the officer's careless act.
The supervisor gave you a poor answer. Go up the chain of command. Talk to the Police Chief or to the Mayor. Be sure to have details ready. Time, date, place information will help identify the offending officer.
It's bad enough when police officers kill or injure themselves in traffic accidents without taking an innocent along with them.
